Welcome to Hubneta. These Terms & Conditions govern the use of the Hubneta mobile application, website, and related services (the “Service”) operated by Hubneta Pty Ltd. By accessing or using the Service, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use the Service.
1. Eligibility
You must be at least 16 years old to use the Service. By using the Service, you confirm that you meet this requirement and have the legal capacity to enter into these Terms.
2. User Accounts
Some features of the Service may require registration. You agree to provide accurate and up-to-date information and to keep your account details secure.
You are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms.
3. Subscription and Payment
The Service may offer subscription plans that provide enhanced visibility and additional features for businesses, creators, and communities, including extended update capabilities, promotional placement within tiles, and access to analytics or engagement tools. Features may evolve over time.
Subscription fees and plans may change with reasonable notice. By subscribing, you authorise Hubneta Pty Ltd or its authorised payment provider to charge your selected payment method.
Subscriptions may be billed monthly or annually and will automatically renew unless cancelled before the end of the current billing period. Payments are non-refundable except where required by applicable law.
4. Use of the Service
The Service provides a platform for discovering and sharing information about businesses, creators, communities, and local activity.
You must not use the Service for unlawful purposes, to infringe the rights of others, or to interfere with the operation of the Service, including by attempting to scrape or extract data without permission.
The Service may include user-generated content and listing information. Hubneta Pty Ltd does not provide, endorse, or guarantee any products, services, or information made available through the Service.
5. Content and Intellectual Property
All software, interface design, graphics, and other materials forming part of the Service are the property of Hubneta Pty Ltd or its licensors and are protected by intellectual property laws.
Users, businesses, creators, and communities retain ownership of content they submit or upload. By submitting content, you grant Hubneta Pty Ltd a non-exclusive, worldwide, royalty-free licence to host, display, and distribute that content for the purpose of operating and promoting the Service.
You are responsible for ensuring you have the necessary rights to any content you submit.
You must not reproduce, redistribute, or commercially exploit any part of the Service without permission.
6. Listings and Unclaimed Tiles
The Service may display listings representing businesses, creators, or communities, including listings that have not been claimed.
Unclaimed listings are provided for informational and identification purposes only. Hubneta Pty Ltd is not affiliated with, endorsed by, or in partnership with any unclaimed listing.
Names, logos, trademarks, and other identifying information are the property of their respective owners and are used solely to identify the relevant entity.
Hubneta Pty Ltd does not guarantee the accuracy, completeness, or currency of any listing. Information may not reflect recent changes to an entity’s operations, activities, or status.
Owners or authorised representatives may request to claim, update, or remove a listing by contacting support@hubneta.com. We will take reasonable steps to review and respond to valid requests.
7. Content Rules
Users must not post content that is unlawful, misleading or deceptive; infringes intellectual property rights; contains malware or harmful links; or is abusive, defamatory, obscene, or discriminatory.
We may remove content or restrict access where these rules are breached.
8. Privacy and Data Collection
Hubneta Pty Ltd may collect and use personal information, including account details, location information, and usage data, to operate and improve the Service.
By using the Service, you consent to the collection and use of your information in accordance with the Hubneta Privacy Policy, which forms part of these Terms.
9. Limitation of Liability
The Service is provided “as is” and we do not guarantee that it will be uninterrupted, error-free, or always available.
To the extent permitted by law, Hubneta Pty Ltd is not liable for any loss or damage arising from your use of the Service, including reliance on listings or user-generated content.
Nothing in these Terms excludes any rights you may have under the Australian Consumer Law.
10. Indemnity
You agree to indemnify, defend, and hold harmless Hubneta Pty Ltd, its directors, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal costs) arising out of or in connection with:
- your use of the Service;
- any content you submit, post, or upload to the Service;
- your breach of these Terms & Conditions; or
- your violation of any law or the rights of any third party.
11. Termination
We may suspend or terminate access to the Service at any time if you breach these Terms or misuse the Service.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes are published constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and any disputes will be subject to the jurisdiction of its courts.
